44-800.2 is an Executive Order issued by Governor Cuomo in June 2020 to re-establish New York State’s commitment to providing a free and quality public education to all students regardless of immigration or citizenship status. It applies to district, charter, and private schools across New York State and ensures that pre-K to 12th grade students who are undocumented will be able to attend all state schools free of charge and receive the services and support they need to succeed. The Order requires all districts to use inclusive language and accurate school records, prohibits the schools from collecting information regarding the citizenship or immigration status of students, and states that engaging in such activities would be a violation of the New York State Education Law. The Order also establishes the Education Equity Program, which provides guidance and resources to support the educational needs of students attending all schools in New York State.
